The US Office of the Comptroller of the Currency (OCC) has finalized regulations implementing the GENIUS Act, establishing a federal supervisory framework for payment stablecoin issuers as Washington seeks to strengthen its position in the global digital asset industry.
Announced on October 21, 2026, the final rule establishes requirements covering reserve backing, redemption, custody, risk management and regulatory reporting for stablecoin issuers operating under OCC jurisdiction.
US Treasury Secretary Scott Bessent welcomed the decision, describing the GENIUS Act as a landmark development that further establishes the United States as a global cryptocurrency centre. Bessent compared the legislation with the National Currency Act of 1863, which created a federal framework for bank-issued currency under President Abraham Lincoln.
The GENIUS Act, signed into law on July 18, 2025, and the OCC’s implementing regulations will take effect on January 18, 2027.
The announcement represents a major regulatory milestone, although separate requirements concerning anti-money laundering and sanctions compliance remain unfinished.
Final Rules Establish Stablecoin Issuer Requirements
The OCC’s final regulations establish standards for companies issuing payment stablecoins, including subsidiaries of national banks, federal savings associations, approved nonbank issuers and certain state-regulated entities. Foreign stablecoin issuers seeking access to the US market also face regulatory requirements under the framework.
The rules require qualifying issuers to maintain reserves sufficient to back their outstanding stablecoins and establish procedures for timely redemption. Issuers must generally process redemption requests within two business days, subject to applicable conditions.
Additional provisions address operational risk, audits, supervisory reporting, custody arrangements and capital or operational safeguards. The framework also establishes procedures for regulatory applications, registration, examinations and potential revocation of issuer approvals. Most requirements appear in a new regulatory section, 12 CFR Part 15, alongside amendments to existing banking supervision regulations.
The OCC received hundreds of public comments following its February 25 proposed rulemaking, including submissions from cryptocurrency companies, banks, industry associations and academics. One significant provision concerns stablecoin rewards.
The rules maintain restrictions on issuers paying interest or yield solely for holding or using payment stablecoins. However, the OCC removed a proposed presumption that certain third-party reward arrangements automatically violate those restrictions.
Such arrangements remain subject to regulatory examination, leaving room for compliant incentive structures while preserving the statutory prohibition on direct issuer yield.
Treasury Sees Opportunity for US Financial Leadership
The finalized framework is intended to support broader adoption of dollar-denominated stablecoins within regulated financial markets. Stablecoins such as USDC and USDT are widely used for cryptocurrency trading, cross-border payments and blockchain-based settlement.
A clearer federal framework could encourage participation by banks, payment companies and institutional investors that previously faced uncertainty over issuer authorization and supervisory expectations. However, implementation remains incomplete.
The OCC confirmed that requirements concerning the Bank Secrecy Act, anti-money laundering controls and Office of Foreign Assets Control sanctions will be addressed through separate rulemaking coordinated with the Treasury Department.
The agency has also not begun accepting applications from prospective federally qualified stablecoin issuers. It will announce the application timetable separately. The distinction matters because publication of final regulations does not automatically authorize existing or prospective issuers. The OCC will also coordinate with other federal and state regulators responsible for implementing different provisions of the GENIUS Act.
For cryptocurrency companies, the framework establishes a clearer pathway toward regulated dollar-backed token issuance, while introducing substantial compliance obligations. For traditional financial institutions, it creates additional opportunities to participate in blockchain-based payments and settlement.
The immediate milestone is January 18, 2027, when the law and OCC regulations take effect. Their longer-term significance will depend on issuer adoption, regulatory coordination and the development of a functioning federal licensing system.
